Design Rules

DESIGN COMMITTEE RULES
As of December 9, 1995**

'Rule No. 1. - Wastewater Treatment and Disposal System
Each dwelling constructed on a lot must be served by a wastewater treatment and disposal system which shall be designed, constructed, operated and maintained in accordance with the general requirements of Chapter 38, Public Health Regulations, Department of Health, State of Hawaii, as the same may be amended.

Rule No. 2 - Set-Back Rule
Effective January 1, 1990 there will be a thirty (30) foot front, back, and side set-back measured from the nearest lot line for all construction on Kawela Plantation Homeowner lots.

Rule No. 3 - Waste Water Treatment systems - Hawaii State Requirements Repealed.

Rule No. 4 - Underground Utility Wire Rule
Effective July 7, 1991 electrical, telephone and other utility service typically provided by overhead wires shall be installed underground when providing service to individual lots. However, if it is necessary to cross the road to provide this service, the crossing may be overhead but must immediately proceed underground.

Rule No. 5 - Enforcement and Penalty Rule
All lot owners who start work without official sanction of the Design Committee or fail to comply with the provisions of the Declarations of Covenants and Restrictions will be subject to a fine, the amount to be determined by the Board of Directors.

Rule No. 6 - Board Approval of Design Committee Rules
All Design Committee Rules shall be subject to the approval of the Board of Directors of the Kawela Plantation Homeowners Association.

Rule No. 7 - Set-Back Exclusion Rule
Driveways, fences, rock walls, and sidewalks shall be excluded from Rule No. 2 - Set-Back Rule.
